Another update. Now they are really pissed. Just got another PDF letter from the same Rambo attorney (photo above; but I won't print his name) saying that in response to my last post about doing things transparently he wants to remind me that while this "course of action" is of course mine to take, he feels it is his duty to inform me that Apple's lawyers have identified at least three posts in my archive that they "deem to be actionable." He says Apple hopes this can be a "conversation rather than a confrontation" [isn't Johnnie Cochran dead? ed.] and that before I turn this into a public fight by continuing on my current "course of action" I should perhaps consider the potentially serious consequences to myself and my family of doing so.
This is followed by a recommendation that I retain an attorney to represent me. And then, I swear to friggin God, there's a list of my assets with an estimated value for each and I suppose the implied threat that I stand to lose them. Which kinda scares the living shit out of me, to be honest, since they've got a pretty thorough list, which means they've been doing some research on this and the offer didn't just come out of thin air. Their lists includes my home address, most recent assessed value of my house and all the information about my mortgage; a rental property that we own; my bank accounts and investment accounts, including the college funds for our kids, whose names are used; and our boat and two cars.
Damn. And right at Christmas. I am going to go make myself a drink.

Okay, Dan. This is serious shit. I hope you do in fact contact the EFF. Satire has proven time and again to be protected. I'd be curious to know what three items they consider "actionable." They can't do it on the basis of slander, because they haven't called for a retraction, and it's damn near impossible to slander a public figure anyway, particularly when your shit is explicitly made up.
For the same reason, they couldn't go after you for disclosing competitive information.
As scary as the list of your assets is, I've got to think it's a bluff because they don't really have any legal grounds, and thus there's another way to get at you. They can only resort to inspiring fear. Of course it's easy for me to say, since I don't have anything personally at risk. But the outcry over Think Secret would be nothing compared to what would happen if they went after you.
I hope the mainstream press picks this up and howls good and loud.

Second, Imitation Jobs must take immediate steps to protect assets. There are certain subsidiaries of certain holdings companies that exist outside of reach of even Apple Legal. Such holding companies often involved in multinational gas, oil exploration. And yeah, what bobdmac said is true, at least in my case. My father has made himself somewhat of a public figure, so that opens himself up to attacks. We have been told numerous times, that such slander is allowed because he is a public person. However, because I am not soooo public, I get a bit more protection, and can have slanderous posts removed about me. Granted, he's only public in our community, on the political side, but still, somewhat similar.
And I would imagine it's not that hard to get a list of your assets. I never gave my cell phone to debt collectors, yet they still find me and call me. And I would imagine you are just a bit of a public person, working for a magazine, writing a book. So it would be even easier to locate information about you.
It's probably a scare tactic from them. The smaller sites, the kids in college, this would scare the crap out of them, they thought they were innocent, and then they get a list of what they thought was personal stuff, from somebody they don't know. So they bow down.
But since this is run by Google, couldn't they have just gone to Google instead, and had it shut down?
You need to hit back hard and coutnersue. This is all legally protected free speech since it is clearly parody, and a violation of your civil rights for them to be threatening you. You offer humorous insights into public situations involving public corporations and public figures. They can't take your site down any more than they could stop the publication of your book.

I know it's easy to say when my assets aren't on the line, but this is the fight of your life, and you can't back down to this. I'll defer to any attorneys out there, but my recollection is that under California law (which may not apply), an aggrieved party has a certain period from their notice of the offending publication to demand a retraction, and only if the retraction is not forthcoming within 21 days (I think) is there an actionable cause. Oh, and you're right, it's libel,which is written, not slander, which is spoken.
What the hell? Seriously, the EFF only defends people they like? Maybe they don't like freedom of expression, I don't know. I'm just glad the ACLU doesn't operate the same way. It's too bad this is out of their bailiwick.

The only Apple product I ever bought was a 4GB iPod. I used it for about a month and then didn't use it for about a year. Then one day I tried to use it and the battery was completely dead, gone. It wouldn't even turn on or show any sign of life plugged in or not. Learnt my lesson. That was the last Apple item I purchased, so much for the sealed battery.

I wouldn't fear the information they have on you. From the information you posted, its a 30 second search on Lexis-Nexis. Any legal team worth anything will look at a site and all the information is pretty much readily available. Mortgage info is public record.

I have been in the market for a new Media Player for a few months, tired of only 2gb on my first gen Nano and this just decided it. I went out today and Bought a Zune at least partially because of this! I can't believe that a company would be so short sited. They seem to imply they are being open and trying to work with you and yet they don't even tell you what three posts they have a problem with? I was actually leaning toward the ipod classic until I read this the today. Their are times I don't care for MS either but to be honest, I feel that in most cases at least you know where you stand with Microsoft. BTW the Zune version 2 kicks the IPODs Tail!!!!!!!!! I loved my Nano but wow the Zune takes it to a whole different level. There are a lot of really really cool things I didn't even know about it before I got it home, anyway the whole point of my writting all of this is...... EVERYONE pay attention!!!
If you want to express your displeasure email Apple corporate as I am and take your business to other companies and explain to them that this is what you are doing and why. They will get the picture pretty quick if they get a couple hundred or thousand emails like this. It doesn't take much to much for a huge company impact to become apparent. They don't want to lose the $$$ this will cost, there is NO WAY that FSJ has enough assets to offset the negative impact what they are doing will cause, if myself and others like me are successful while they continue on this track.(hopefully there will be others)

I'm not sure about this... but I would say they (Apple Sharks) have probably broken either directly or by proxy some privacy laws. The information about your personal finances they included the "Stick" letter may have been obtained by pretexting. In most cases this done by investigating service that basically lies / frauds the information from the source. You might want to check into it. It could give you some valuable leverage.
If it turns out they are retaining a company that has a reputation / history for pretexting you could really bend them over!

I've been involved in a lot of legal action with assets etc over the past year--dealing with insurance companies. Be aware nobody can claim your home or vital living assets--this is covered by law and mainly includes your house/bank funds or trusts. Next be aware that Apple cannot make threats against you or your family, and if they continue to try to intimidate you, you can sue them. Do not submit to anything they try to make you do.
Hire a lawyer and contact the EFF immediately.
I love your blog, and I believe you're in the right, but cut your losses and move on. There are other things to write about. Apple lost its sense of humor, and this legal battle will claim yours. You might win, but will you even want to continue writing as FSJ?

It takes lawyers about two minutes to get the information about your assets from the secretary of state of your home state. Anyone can do it as it is public record, believe it or not. Your creditors file the fact that they hold an interest in some item you are buying on time with the secretary of state so that if you are sued they, the creditors, get paid first should the item be sold as a result of the suit.
You are right, they are trying to scare you. But be aware, they are not allowed to threaten you without following through on the threats. They can be disbarred if they do. It costs someone like Apple a LOT of money to sue you, so unless you have a LOT of assets, they would only sue you to make an example of you. However, that is very risky on their part because if you win, they are up sh*t creek.

I urge you to take them seriously. They have not filed suit and you have not filed Bankruptcy. Simply transfer ownership of the assets by the normal course of end of year business a family does, to your children, to a trust or to a corporation for the benefit of your children. That way you have no assets and all they can get is a charging order against your salary, if any. Perhaps your website should give you a pay reduction and tender that to the children's trusts to cover maintenance costs. Let them sue, then countersue for harassment.

I'd take the list of assets they have of you and inquire as to how they found that information. Sure, some of it may be public data, but money asset balances are not (and in fact protected by various acts put into place to combat terrorism).
It would be a shame if you suddenly signed all your assets over to someone else.

I suggest you do what most people do in these situations: say one thing, and do another! Agree to the lawyers to keep things private, and make sure to publicly announce any private decisions you may make. This way you can have your cake and eat it.

If Apple's legal team has compliled such a comprehensive list of your assets I suggest getting an attorney for yourself. I would also get a credit report immediately including alist of inquiries against your history. Also, advise apple to go ahead with the lawsuit and then have your lawyer file full discovery motions for apple's pre-lawsuit investigation files. There are privacy laws in the US and I am willing to bet your rights have been violated which would put you in an actionable position. (How would you like to sue apple?)

Though I am sure you have, be sure that this isn't a forgery. It is easy enough to get the info, just be a client of the credit bureau service. Its easy enough to do the forgery. This is pretty good. I almost believed it considering the iMac monitor fiasco and Apple "screening" any negative posts on their support forums. Same with Leopard, in case anyone noticed. But no legal team worth their paycheck would ever give a green light on a tactic like this, especially considering the relative popularity of this forum. Not to mention, they wouldn't have a kneecap to stand on in court. They WOULD, however, have a leg to stand on if they sued this guy for slander. If Apple legal never sent him such an e-mail, they'd have plenty of evidence right here in this forum of monetary loss by this lie.

Of course this isn't real. It would be cool to see a fake PDF from Apple too. A great way to get people to come to your blog though, that's why I'm here. Check out this on the iPhone too.
